These Terms and Conditions govern your access to and use of the TopFrancais Academy website, student dashboard, onboarding flow, lessons, downloadable resources, learner's community, events, live classes, advisory support, and paid learning programs. By using our services, you agree to these Terms.
1. About TopFrancais Academy
TopFrancais Academy provides French language education, introductory lessons, course guidance, learning resources, online classes, exam preparation support, and related learner services. Some services are free, while others require payment or enrolment in a learning package.
2. Eligibility
You must be able to lawfully use online learning services in your location. If you are under the age of majority, you should use the services only with the involvement and consent of a parent or guardian. By using the services, you confirm that the information you provide is accurate and that you have authority to agree to these Terms.
3. Student accounts
You are responsible for keeping your login details confidential, maintaining accurate account information, and notifying us promptly of unauthorized access or suspicious activity. You may not share, sell, transfer, or misuse your account. We may suspend or restrict access if we believe an account has been compromised or used in violation of these Terms.
4. Signup, onboarding, and dashboard access
After signup, you may be asked to complete onboarding, select learning goals, choose an experience level, access starter lessons, complete a placement quiz, view pricing, and contact an advisor about classes. We may update the onboarding flow, dashboard features, learning paths, and available resources as the platform develops.
5. Free resources and introductory lessons
We may provide free starter lessons, videos, ebooks, quizzes, and other introductory materials. These resources are provided for personal learning only. Availability may change, and we may add, remove, or revise free materials at any time.
6. Paid courses, classes, and learning packages
Paid programs may include live classes, personal coaching, speaking support, exam preparation, downloadable resources, community access, or other learning services described at the time of enrolment. The exact features, schedule, duration, tutor availability, and support level depend on the package or course you choose.
7. Payments, subscriptions, and billing
Prices, currencies, billing cycles, payment methods, and package details are shown or communicated before purchase. You agree to provide accurate billing information and authorize applicable charges when you buy a paid service. Subscriptions, where offered, may renew unless cancelled according to the terms presented at purchase.
8. Refunds and cancellations
Refund eligibility depends on the specific course, learning package, promotion, or subscription terms communicated at purchase. Some digital resources, completed classes, missed sessions, or partially used services may be non-refundable unless otherwise required by applicable law. If a refund is approved, processing time may depend on the payment provider.
9. Live classes, scheduling, and attendance
Class schedules, tutors, and session times may change due to availability, time zones, technical issues, holidays, or operational needs. You are responsible for joining sessions on time and ensuring you have a working device, internet connection, microphone, and any required learning tools. Missed classes may not always be rescheduled.
10. Learner's community and events
We may provide access to learner's community spaces, discussion groups, events, or external channels such as WhatsApp, Telegram, Discord, Zoom, or Google Meet. These spaces are intended for learning, practice, encouragement, and school-related communication. Access may be moderated, limited, changed, or removed at our discretion.
11. Community conduct
You agree not to:
- harass, threaten, insult, exploit, or discriminate against others;
- post spam, scams, misleading claims, or unauthorized promotions;
- share another person's private information without permission;
- record, copy, or distribute classes without consent;
- disrupt lessons, events, groups, tutors, staff, or learners;
- upload malicious files, links, or harmful code; or
- use the services for unlawful, abusive, or dishonest purposes.
12. Intellectual property
The website, lessons, videos, worksheets, ebooks, quizzes, class materials, brand assets, designs, copy, and other content are owned by TopFrancais Academy or its licensors unless stated otherwise. You receive a limited, personal, non-transferable right to access and use learning materials for your own study. You may not copy, sell, publish, distribute, upload, train AI systems with, or create competing products from our materials without written permission.
13. User content and feedback
If you submit messages, quiz answers, assignments, testimonials, feedback, or other content, you remain responsible for that content. You grant us permission to use it as needed to operate, provide, review, improve, and support the services. We will seek appropriate consent before using identifiable testimonials or learner stories for public marketing.
14. Learning outcomes and exam results
We aim to provide high-quality French learning support, but we do not guarantee a specific grade, exam score, fluency level, immigration outcome, job outcome, admission result, or personal learning result. Your progress depends on attendance, practice, effort, prior knowledge, and other factors outside our control.
15. Third-party services
The services may rely on or link to third-party platforms for authentication, hosting, email, payments, messaging, video, scheduling, analytics, or community access. We are not responsible for third-party services that we do not control. Your use of those services may be subject to their own terms and privacy policies.
16. Service availability and changes
We work to keep the platform useful and available, but we do not guarantee uninterrupted, error-free, or permanent access. We may update, suspend, discontinue, replace, or limit any part of the services, including free resources, dashboard features, community spaces, class formats, or pricing pages.
17. Prohibited misuse
You may not attempt to reverse engineer, scrape, overload, attack, bypass security, gain unauthorized access, interfere with platform operations, impersonate another person, misuse payment systems, or use the services in a way that violates law or harms TopFrancais Academy, tutors, staff, learners, or third parties.
18. Suspension and termination
We may suspend, restrict, or terminate access to accounts, classes, resources, or community spaces if we reasonably believe these Terms have been violated, payment has failed, access is being misused, or action is needed to protect the platform or other people. You may stop using the services at any time.
19. Disclaimers
The services and content are provided for educational purposes and are made available "as is" and "as available" to the fullest extent permitted by law. We do not warrant that every feature, class, resource, event, or third-party link will always be available, accurate, current, secure, or error-free.
20. Limitation of liability
To the fullest extent permitted by law, TopFrancais Academy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, learning opportunity, or business opportunity arising from use of the services. Nothing in these Terms limits liability that cannot legally be limited.
21. Indemnity
You agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the services, violation of these Terms, unlawful conduct, or infringement of another person's rights.
22. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information. By using the services, you also agree to the practices described in the Privacy Policy.
23. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate. Continued use of the services after changes become effective means you accept the updated Terms.
24. Governing law and dispute resolution
These Terms are governed by the laws applicable to TopFrancais Academy's place of operation, except where mandatory consumer protection laws in your location provide otherwise. Before starting a formal dispute, both parties agree to try to resolve concerns in good faith by contacting each other first.
